The Law on Prostitution in Virginia
The Virginia Code addresses crimes that involve indecent behavior. According to the §18.2-346 of the Virginia Code, there are two crimes of indecency: prostitution and solicitation of prostitution.
If any person performs sexual acts for money or anything equivalent to that, they will be found guilty of prostitution.
Similarly, any person offering money to another in exchange for sexual acts will be guilty of soliciting prostitution.
Moreover, the Virginia Code outlines multiple offenses that are related to the crime of prostitution such as:
- Visiting a bawdy place: This is when you visit a place where sex is being bought or sold as per §18.2-347
- Aiding in prostitution: You will be charged under this offense if you aid and abet prostitution. Even buying prostitution for someone else is enough to be convicted as per §18.2-348
- Intentional indecent exposure: Any person who intentionally makes an obscene display of his or her private parts in any place where there are others present can be guilty of a misdemeanor as per §18.2-387.
- Detaining someone and compelling prostitution: You may be charged under this offense if you detain someone and take them to be involved in prostitution, as per §18.2-355.
- Accepting money for coercing someone into prostitution: In the event, you coerce someone to engage in prostitution you will be charged under this offense as per §18.2-356.
Penalties for Prostitution in Virginia
- The solicitation of a prostitute is charged as a Class 1 misdemeanor offense. However, felony charges may be applicable in some states depending upon the surrounding facts of a case. Felonies are more serious offenses as compared to misdemeanors and have more significant penalties associated with them.
